Profectus Learning and Talent Solutions Private Limited (Profectus) has taken due care to ensure that the contents and digital products on this website are of acceptable quality and is free of any copyright violations. In case there are any inaccuracies, then Profectus shall undertake liability not exceeding the amount directly received by Profectus from the concerned aggrieved person.

 

Terms and Conditions for digital products​

1. Acceptance of Terms: By downloading or using any of our digital products including media, documents, you agree to be bound by the terms and conditions prevailing at the time of the download.

 

2. License and Use

License Grant: When you purchase our digital products, you get a non-exclusive, non-transferable, irrevocable license to use it.

Restrictions: You shall not redistribute, sell, lease, or otherwise transfer the it to third parties. Modifications for internal use are permitted, but you may not remove or obscure proprietary notices.

User Responsibility: You are responsible for ensuring the utility is used in compliance with all applicable laws and regulations.

3. Payment and Delivery: 

Payments: All the payments to our digital products must be made prior to download. We accept online payment methods as indicated on the website.

Delivery: After payment confirmation and acceptance of these terms, you will receive a download link to the product.

4. Intellectual Property:

Ownership: The intellectual property (IP) of all the utilities stays with Profectus. You do not get any ownership of the IP.

Restrictions: Reverse engineering, decompiling, or disassembling the software is prohibited

5. Disclaimer and limitation of liability:

No Warranty: The FAR utility is provided “as is” without warranties of any kind, whether express or implied. Profectus does not guarantee that the utility will meet your requirements or that its use will be uninterrupted or error-free.

Liability: If any of our digital products have defects, we shall be liable to rectify the same and provide the rectified version to you. If the defect cannot be rectified, our liability shall be restricted at most to the amount paid by you to Profectus, directly. We shall not be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the product.

6. User responsibility:

• Accuracy of Data: You are solely responsible for the accuracy of the data you input and the results you obtain from the utility.

• Backup: It is your responsibility to maintain backup copies of your data.

7. Governing laws and regulations: All the transactions in this website shall be governed by the laws and regulations of India. And disputes, if any, shall be subject to the exclusive jurisdiction of the courts in Tamil Nadu, India.

Cancellations and refunds

Digital Products

All sales of digital products through this website are final. Refunds will not be issued for downloads following the completion of a purchase, except as required by law or in instances where the product is defective and the defect cannot be remedied. Customers are encouraged to review all details and system requirements before completing their purchase.

Events & Training Programs

• Booking Window: Bookings for events and training programs may be canceled up to 7 days prior to the event start date. Cancellations must be submitted in writing via the designated channels indicated on the website.

• Refund Process: For cancellations made within this 7-day window, subject to validation, the amount paid—net of any bank or payment gateway processing charges and applicable taxes—will be refunded using the original payment method.

• Late Cancellation: Cancellation requests received less than 7 days but more than 3 days before the event start date will be subject to a 25% cancellation charge. The remaining amount, after deducting this charge, as well as any bank, payment gateway fees, and applicable taxes, will be refunded via the original payment method.

• No Cancellation Within 3 Days: Cancellations will not be permitted within 3 days of the event start date. No refunds will be issued for cancellations made during this period.

Cancellation by Profectus

In the event of program cancellation, rescheduling, or modification by the organizers, participants will be notified promptly and offered the option of a full refund or transfer to a rescheduled session, as applicable.

This policy is subject to change at the sole discretion of the company. In all cases, refunds will be processed in accordance with applicable laws and regulations.
